UPDATES ON THE AMENDMENTS MADE ON THE DRUGS AND COSMETICS RULE 1945 (AMENDMENT RULES 2018) ON LABELING OF MEDICINES RULES 96 & 97

Goal: The research study was performed to examine the labelling of OTC drugs in India as per the standards of United States FDA. INTRO:

96. Way of Labelling.–( 1) Subject to the other arrangements of these Rules, the following details will be either printed or composed in enduring ink and will appear in a noticeable way on the label of the inner container of any drug and on every other covering in which the container is loaded, particularly:–.
( i) the name of the drug −.
In the Cosmetics and drugs Rules, 1945 (hereinafter to be referred as the stated guidelines), in guideline 96, in sub-rule (1 ), in stipulation (xi),–.
( a) for the part starting with the words “In addition to the” and ending with the words “in the above list:”, the following will be replaced, specifically:–.
” In addition to the other details which are needed to be printed or composed under these guidelines, the label of inner most container of the following classifications of drugs and every other covering in which the container is jam-packed will bear a care or caution, as appropriate, depending upon whether the drug is covered under Schedule G or Schedule H or Schedule H1 or Schedule X, as defined in guideline 97, in understandable black coloured font style size in a totally red rectangle-shaped box without troubling other conditions printed on the label under these guidelines, particularly:–.
Narcotic analgesics, hypnotics, sedatives, tranquillisers, corticosteroids, hormonal agents, hypoglycemic, antimicrobials, antiepileptics, antidepressants, anticoagulants, anti-cancer drugs and all other drugs falling under Schedules G, H, H1 and Schedule X whether covered or not in the above list:.
Supplied that if any of the drug referred above classification is not covered under any of the Schedule, specifically, Schedule G, Schedule H, Schedule H1 and Schedule X, the label of inner most container of drugs and every other covering in which the container is jam-packed will bear care or caution, as the case might be, appropriate for that drugs covered under Schedule H as defined in guideline 97.”; (Ministry of Health and Family Welfare G.S.R. 408 (E).).

Description: The labeling of the inner container and every other external covering in which the container is jam-packed will be printed or composed under these guidelines will bear a Caution or Warning as suitable, depending upon the Pharmacological classification of the drugs which are covered under Schedule G, Schedule H, Schedule H1 and Schedule X as defined in Rule 97, in qualified black font style size in a totally red rectangle-shaped box without disrupting other conditions printed on the label under these guidelines particularly:.
Narcotic analgesics, hypnotics, sedatives, tranquillisers, corticosteroids, hormonal agents, hypoglycemic, antimicrobials, antiepileptics, antidepressants, anticoagulants, anti-cancer drugs and all other drugs falling under Schedules G, H, H1 and Schedule X whether covered or not in the above list:.
If the drugs discussed above are not covering under any of the Pharmacological Categories of the Product schedule, particularly, Schedule G, Schedule H, Schedule H1 and Schedule X, the label of inner most container and every other external in which the drug is jam-packed will bear Caution or Warning as the case might be, suitable for that drugs covered under Schedule H as defined in guideline 97.
Example: For those drug which do not comes under the sneak peek of Schedule H caution or Caution however as per the drug and cosmetic guideline 96.
Narcotic analgestics, hypnotics, sedatives, tranquillisers, corticosteroids, hormonal agents, hypoglycemics, antimicrobials, antiepileptics, antidepressants, anticoagulants, anti-cancer drugs and all other drugs falling under Schedules ‘G’, ‘H’, and ‘X’ whether covered or not in the above list: (Garg Ram Avatar (Adv))

Rule No. 97

3. In the stated guidelines, in guideline 97, in sub-rule (1 ),–.
( i) for stipulations (a) to (e), the following provisions will be replaced, specifically:–.
“( a) if it consists of a drug compound defined in Schedule G, be identified with following words in readable black coloured typeface size in entirely red rectangle-shaped box:.

SCHEDULE G PRESCRIPTION DRUG– CAUTION
